Looks like I will be getting either a Genuine Buddy 50cc or a roughhouse 50cc.
NY doesn't go by CCs for running on a regular, non-motorcycle driver's license, but by top speed..which is 30mph.
I understand that often the 2T engined 50 ccs will do 40 even without derestricting. Question, if I buy either of those two scooters..is the law likely to get on my case if I am doing 40 mph?
What is your experience?

NY is probably the same as Federal.

As long as you are within 15MPH of the posted speed limit they can do nothing. Under 40 as long as you have your 4-way flashers running. I dont think you need to be out on the Thruway or and Interstate. State Highways should be your limit. Worst thing that "Could Happen" is they give you a ticket for a BS charge of "Impeding Traffic"

I have over 300 miles on my new roughhouse. Of course I wouldn't run on an interstate..and not just because it is illegal. Even if it were somehow legal, it still would not be prudent. I have run state highways with nary a problem. In fact, the state highways with a broad, paved shoulder is my preferred ride. I just keep a sharp eye in my rear view mirror, and if a vehicle approaches from the rear, I just dip over onto the shoulder until they pass.
As was mentioned, I had a 2009 Kymco people 150..a very highly rated scooter. Except for the power situation, I prefer my Roughhouse in almost every way.
Surely a 125cc Roughhouse would be a formidable coup in the scooter market.
